Service Specific Terms - Telco

The service described in this policy will only be available in the countries listed and will be considered valid for use in the countries listed. If you purchase a service from a country not listed and are unable to use it, the purchased service cannot be refunded, nor will Getcontact be held responsible.
This Service Specific Terms – Telco (“Telco Terms”) is available in multiple languages; however, in the event of any execution, interpretation, dispute, or legal proceeding, the English version shall prevail.
The Getcontact Telco Services (“Telco Services”) described in detail below under these Telco Terms are provided through a licensed intermediary service provider; when the service is used, number ownership verification is not conducted. In this regard, if you purchase the following services through a number that belongs to someone else and a loss occurs, you expressly accept that all liability will be yours.
- Assistant Service or Assistant: The Assistant Service provides you with the capability to forward calls when your phone is turned off, unreachable, busy or missed, get information about calls before you answer them, and know who is calling. It allows to access a conversation between the Assistant and the caller. The Assistance Service allows you to receive answers to calls by asking pre-recorded interactive questions that can be customized, and to communicate those answers to you.
- Call Manager Feature: In addition to Assistant service, you may benefit from the service of answering calls when your phone is on the airplane mode (requires wifi connection). (This service is only available for devices using Android operating system.) Depending on the operator's technical capabilities, it allows you to see the numbers of incoming calls from a hidden number. It allows you to see the caller ID of the callers on the screen, even if it is not saved in your contacts.
- Personal Asisstant Feature: (i)Our Assistant Service may record sound and text interactions between the caller and the Assistant for purposes including, but not limited to, enhancing the quality of our services, and for confirming details of the call. The caller will be asked who is calling and the reason for the call. Users will have the ability to access, review, and listen to these recordings within the Getcontact application. (ii) By enabling the Assistant Service, you consent to the recording and storage of these interactions by Getcontact or third parties service providers. Certain states or countries may have laws prohibiting the recording of calls without consent from the parties involved. Recording a telephone conversation without informing the other parties may result in criminal liability or civil liability. By installing or using the Getcontact application, you (i) agree to comply with all applicable laws and regulations, including obtaining consent to record where required and (ii) acknowledge that Getcontact is not liable for any failure on your part to comply with these laws and regulations.
- The Call Assistant Feature: This feature operates through a chat-based interface designed to facilitate call management. This feature can interpret text-based commands submitted by users via the chat screen and perform various functions, including routing and prioritizing calls. Users may direct the call management behavior of the Call Assistant by providing valid commands that fall within the system’s scope. The Call Assistant will notify users when it encounters unsupported or out-of-scope requests, but will not take any further action in such cases.
Valid commands submitted by users may be stored in a personal memory created specifically for the user, solely for the purpose of enabling call management. The information stored in this memory is used to route calls based on the user's preferences. If the user's memory does not contain sufficient data, the system will apply default scenarios predefined by Getcontact. Users will not have access to a dedicated interface for this memory under the current version; however, they will be notified by the system when updates are made. For users who do not manually update their memory, a memory summary may be sent at regular intervals.
By enabling the Call Assistant Feature, you consent to the processing of your chat history, submitted commands, and personal memory by Getcontact or third-party service providers authorized for the provision of the service. This data will be used solely for the purpose of delivering and improving Telco Services and will be processed in accordance with the Privacy Policy.
It is the user's sole responsibility to ensure that submitted commands are meaningful, contextually appropriate, and compliant with applicable laws and regulations. Getcontact shall not be held liable for any call routing errors, missed calls, data loss, communication disruptions, or any other direct or indirect damages resulting from incomplete, incorrect, or contextually irrelevant commands submitted by the user. Sample scenarios provided by the Call Assistant are for informational purposes only and are not legally binding. - The feature of finding out who is calling you while your phone is busy: In case of another person is calling while you are currently on a phone call, the caller number is notified by mobile notification.
- The feature of finding out who is calling when your phone is turned off: It is the feature of informing the caller with mobile notification when the first signal is received from your device, if you receive a call while your phone is turned off.
- Out of service feature: In cases where your phone is out of service or cannot be reached, it is the feature of informing the caller with a mobile notification about the calls made to you.
- Voicemail feature: In cases where you cannot answer your phone, cannot be reached, busy or closed, callers will be able to leave a voice message if they wish. You can listen to these voicemails from within the Getcontact.
- Call Recorder Feature: When activated, this feature automatically records incoming and outgoing GSM calls, provided Getcontact is set as the default call manager. At the start of each recorded call, an audible message such as "This call is being recorded by one of the participants" is played to both parties. Recordings can be accessed only within the Getcontact app under the 'Recent Calls' tab and cannot be downloaded. You may disable this feature anytime in the app settings; when disabled, no calls will be recorded. Due to technical constraints, while the feature is active: (i) conference calls are disabled; (ii) placing the call on hold is not possible; and (iii) recordings are limited to 2 hours. By using this feature, You consent to the collection and processing of metadata and voice recordings as outlined in the Privacy Policy. The feature is provided "as is," without warranties regarding the accuracy, legality, or usability of the recordings.Use of this feature must comply with all applicable laws, including notification or consent obligations. You are solely responsible for such compliance and agree to indemnify Getcontact against any resulting claims or liabilities.You must follow the legal requirements of Your region when using the Automatic Call Recording Feature. It is solely Your responsibility to check the relevant laws before using it. The feature functions based on user-defined settings, and Getcontact is not responsible for their accuracy, legal validity, or any technical issues related to configuration.
- Hidden number feature: It is the feature of showing you this number according to the country's possibilities if you receive a call from a hidden number. This feature will not be available in all countries. In order to use this feature, you must reject the private number call made to you. The rejected call will be shown to you as a repeat call with the number no longer hidden.
- Flight mode answering feature: It is a call answering feature when your phone is in flight mode. This feature will only be available if you have an internet connection. When you activate the assistant service, the call will be forwarded to your phone if you have an internet connection while your phone is in flight mode.
- Spam detection feature: Our service utilizes an audio technology to analyze the initial seconds of incoming calls to your device. By extracting audio features and matching them against, we try to identify whether a call is likely a spam. This analysis is completed quickly, allowing us to alert you about the nature of the call promptly. This proactive measure enhances your user experience by helping to identify unwanted calls efficiently.
- “Chatty Auntie” Feature: By enabling the “Chatty Auntie” feature, you authorize Getcontact’s AI persona to handle certain incoming calls identified as spam or unwanted. The AI persona may engage with the caller without revealing your personal or sensitive information. You acknowledge and accept that the system's identification process may not be error-free, and some legitimate calls may be misclassified as spam and redirected to the “Chatty Auntie” feature. Getcontact shall not be liable for any missed, misdirected, or mishandled calls, including but not limited to business, emergency, or other important communications. You understand that activation of this feature is entirely at your discretion. By using “Chatty Auntie,” you assume all risks associated with its operation and waive any claims against Getcontact arising from its use. This includes, but is not limited to, any losses, damages, or inconveniences resulting from missed or mishandled calls.
- Data Usage and Privacy Policy: Getcontact collects and processes certain call data to provide and enhance our services. The collected data may include the caller's number, the date, time, and duration of the call, and the content of the interaction between the caller and the Assistant. By using our Telco services, you give your express consent to this data collection, processing, and storage.
- It is crucial to note that Getcontact respects your privacy and upholds stringent measures to protect your data. The use of data is strictly for the purpose of improving the quality of our services and providing you with the optimal experience. Any usage beyond this purpose will be subject to your explicit consent.
- Third-Party Consent: In cases where third-party information is required or incidentally collected in the provision of our services, you represent and warrant that you have the necessary rights and permissions to share this information with us. You acknowledge and confirm that all necessary permissions and consents have been obtained from the recorded people or the sharing of any third-party information as required or incidentally collected in the provision of our services. You also agree to indemnify and hold harmless Getcontact for any claims or actions made by such third parties in relation to the data you have provided.
- Permissions: In order to benefit from Getcontact Telco Services, you must grant the following permissions and approvals. In order to send mobile notifications to your device, notification permission must be turned on in the Getcontact. In order to use our quick contacts feature, which will enable you to interact quickly with Getcontact users in your directory, you must have given access to your address book. Android device users must have given the default call manager permission in order to activate the assitant service features. IOS device users must also give microphone permission in order to activate the call manager feature. For utilizing the recording feature of the Assistant Service, you must grant permission to record and store the interaction between the caller and the Assistant.
- Fees: Telco Service is offered free of charge in some countries, while in some countries it is offered depending on the subscription package. In countries where the Telco Service is free of charge, you can start using our Telco Services by making related call forwarding settings free of charge without purchasing any premium package within the Getcontact application. If you delete the application, do not use it for a long time or stop using Telco Services, you must cancel the call forwarding feature separately. You can find the relevant cancellation procedures under the setting menu in Getcontact or under frequently asked questions on www.getcontact.com. If you do not cancel the activation, your calls will continue to be forwarded to Getcontact. You can access the voice messages and assistant dialogues sent to you under recent calls in the Getcontact.
By means of a phone number with Türkiye and USA area codes, you can access telco services in certain countries by purchasing them under a premium package or in countries where the service is offered free of charge. Users can start using telco services by configuring the necessary call forwarding settings in countries where the service is free or where a premium package is required. If you stop using Telco Services, you must also cancel the activation explained in FAQ. At the end of the premium package, you will be able to see the audio recordings that come to you until the end of the premium subscription, from within the Getcontact and the same applies to countries where it is offered free of charge.
If you receive service from the country where we provide service through the premium package, You cannot continue to enjoy Telco benefits after the package expires. To use the relevant features again, you must subscribe to the premium package.
If you do not want to use the Telco Service, you must cancel the activation for each service. Otherwise, since your call manager service and assistant service will be active, voice messages and asistant dialogues, and call forwarding will come to Getcontact, but you will not be able to access it from within the application because you do not have a membership.
Getcontact does not charge you any fees for the above-mentioned features other than subscription package / premium package. Not every operator may provide features of Telco service. If your operator cannot provide some features, you may not be able to use all of our services.
Your operator may charge a fee. We recommend that you research before using the service.
- To utilize the Telco Services, you will be guided through a process to configure your phone's conditional call forwarding feature, allowing all calls to be conditionally forwarded to the Assistance Service.
- You are solely responsible for any fees or surcharges imposed by your mobile service provider in connection with the use of the Assistant Service depending on the country and telecommunication operator which you used.
- While we strive to provide the most accurate, current, and comprehensive data available, we cannot guarantee the accuracy of the results provided by the Assistant Service. Due to various factors in speech recognition, the Assistant may not always fully comprehend what a caller says.
- Telco Services may be temporarily suspended, without notice, for security reasons, system failures, maintenance and repair, or other circumstances. In accordance with applicable law, you will not be entitled to any refund for these temporary suspensions.
- We strongly recommend that you keep adequate back-ups of any call recordings and voicemail or transcripts of such recordings that you wish to keep.
- Telco Services are solely for your personal, non-commercial use. Users using any of the Services for commercial purposes are required to select and pay for one or more of the Premium Services.
- For the operation and performance of Telco Services to be working smoothly; you agree that it depends on the compatibility of the device you use and the website/application used by you, and some factors beyond Getcontact’s control such as your device's cache, 3rd party service providers, your phone operator or other technical/data network issues.
- You agree to comply with all applicable laws, regulations, and consent requirements when using GTC Telco Services, including obtaining any necessary permissions from third parties.These features are provided on an “as-is” basis, without any warranty as to their accuracy, reliability, or suitability for a particular purpose. Getcontact reserves the right to update, modify, or discontinue any aspect of these features at any time without any notification. Continued use of these features following any such update constitutes acceptance of the revised terms.
- You further agree to indemnify, defend, and hold harmless Getcontact, its affiliates, officers, employees, and agents from and against any claims, damages, losses, liabilities, costs, or expenses (all legal fees including but not limited to attorney and court fees) arising directly or indirectly from your use of the Telco Services feature, including any engagement with non-spam callers.
